These Terms of Service govern your access to and use of the SplashSource website and your purchase of products or services through it.

By visiting the website, creating an account, requesting a quote, submitting artwork, or purchasing a product, you agree to these Terms of Service and our Privacy Policy.

Do not use the website or place an order if you do not agree to these terms.

1. Eligibility

You must be at least the age of legal majority where you live and legally capable of entering into an agreement to use this website or place an order.

When placing an order on behalf of a company or another organization, you represent that you have authority to act for and bind that organization.

2. Website Use

You may use the website only for lawful purposes.

You may not:

• Attempt to gain unauthorized access to the website, customer accounts, systems, or networks

• Introduce viruses, malicious code, or other harmful technology

• Scrape, copy, reproduce, or commercially exploit website content without permission

• Interfere with the operation or security of the website

• Use the website to violate another person’s intellectual-property, privacy, or legal rights

• Submit fraudulent orders or false information

• Use the website in violation of applicable law

We may suspend or terminate access when we reasonably believe these terms have been violated.

3. Product Information

We make reasonable efforts to present product descriptions, specifications, photographs, colors, and pricing accurately.

However:

• Screen displays and printed colors may vary

• Product colors, materials, dimensions, and packaging may have ordinary manufacturing variations

• Suppliers may change product specifications

• Photographs may show optional decoration or accessories

• Product availability may change without notice

We may correct errors, inaccuracies, or omissions and may update product information at any time.

4. Pricing and Availability

Prices and product availability are subject to change without notice.

Unless otherwise stated, prices may not include shipping, freight, taxes, duties, artwork services, setup charges, rush charges, or other applicable costs.

We may limit quantities, discontinue products, reject an order, or cancel an order when a product is unavailable, incorrectly priced, affected by a website error, or otherwise cannot reasonably be fulfilled.

If we cancel a paid order, we will refund the canceled amount.

5. Orders and Payment

Submitting an order does not guarantee acceptance. An order is accepted when SplashSource confirms it or begins fulfillment or production.

You agree to provide accurate, current, and complete billing, shipping, contact, and payment information.

You authorize us and our payment providers to charge the amounts displayed or otherwise approved in connection with your order.

Orders may be subject to additional verification for fraud prevention, product availability, artwork suitability, shipping requirements, or other fulfillment considerations.

6. Custom Products and Artwork

Many SplashSource products are custom printed or personalized.

When you submit a logo, design, trademark, photograph, wording, or other material, you represent and warrant that:

• You own the material or have permission to use it

• SplashSource and its production partners may reproduce it for your order

• Its use will not infringe another party’s copyright, trademark, privacy, publicity, or other rights

• The material is not unlawful, misleading, defamatory, or otherwise prohibited

You grant SplashSource and its suppliers a limited license to use, reproduce, resize, format, and transmit submitted materials as reasonably necessary to prepare proofs and fulfill your order.

We may refuse artwork that we reasonably believe is unlawful, infringing, offensive, misleading, technically unsuitable, or otherwise inappropriate.

7. Proofs and Customer Approval

When a proof is provided, you are responsible for reviewing all aspects of it, including:

• Spelling and wording

• Product selection

• Imprint content

• Artwork placement

• Colors

• Size

• Quantity

• Shipping information

• Other specifications

Production may begin after approval. Once a proof has been approved and production has started, the order ordinarily cannot be changed, canceled, returned, or refunded.

SplashSource is not responsible for an error that appeared in a proof approved by the customer.

8. Production and Shipping

Production and delivery times vary by product.

Many orders are estimated to be produced and delivered within approximately two to four weeks. Certain products may require 10–14 days for production followed by up to three weeks in transit. Some orders may therefore take approximately five weeks or longer to arrive.

Production time begins only after SplashSource has received all required information, payment, usable artwork, and final proof approval, when approval is required.

Production time and shipping time are separate. Selecting expedited shipping may shorten transit time but does not necessarily shorten production time.

All production, shipping, and delivery dates are estimates and are not guaranteed unless SplashSource expressly confirms a guaranteed date in writing.

Products in the same order may be produced at different facilities and may arrive in separate shipments. Customers are responsible for reviewing product-specific timelines and providing accurate delivery information before ordering.

9. Returns and Refunds

Custom products are generally final sale after production begins.

Returns, defect claims, cancellations, replacements, and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms of Service.

10. Intellectual Property

The website and its content—including text, graphics, photographs, logos, product organization, page designs, and software—are owned by or licensed to SplashSource and are protected by applicable intellectual-property laws.

You may use the website for personal or internal business purchasing purposes. You may not reproduce, distribute, modify, republish, sell, license, frame, or commercially exploit website content without prior written permission.

Customer-owned trademarks and artwork remain the property of their respective owners.

11. Customer Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Notify SplashSource promptly if you suspect unauthorized access or use.

We may suspend or close an account when necessary to protect the customer, SplashSource, or another party.

12. Third-Party Services and Links

The website may use or link to third-party services, including Shopify, payment processors, suppliers, carriers, social-media platforms, and other websites.

Third-party services are governed by their own terms and policies. SplashSource is not responsible for third-party content, availability, security, or practices.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis.

SplashSource does not guarantee that the website will always be uninterrupted, error-free, secure, or free from harmful components.

Nothing in these terms excludes warranties or consumer rights that cannot lawfully be excluded.

14. Limitation of Liability

To the fullest extent permitted by law, SplashSource will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or purchase of a product, including lost profits, lost revenue, lost data, lost business opportunities, or event-related losses.

To the fullest extent permitted by law, SplashSource’s total liability relating to a particular product or order will not exceed the amount paid to SplashSource for the product or order giving rise to the claim.

These limitations do not apply where liability cannot lawfully be limited or excluded.

15. Indemnification

You agree to indemnify and hold SplashSource and its employees, representatives, suppliers, and service providers harmless from claims, losses, liabilities, and reasonable expenses arising from:

• Your violation of these terms

• Your unlawful use of the website

• Artwork or other materials you submitted

• Your infringement of another party’s rights

• False or misleading information you provided

This provision applies to the extent permitted by law.

16. Events Outside Our Control

SplashSource is not responsible for delays or failure to perform caused by events outside our reasonable control, including natural disasters, severe weather, carrier interruptions, labor disputes, supply shortages, equipment failures, government actions, emergencies, wars, civil disturbances, or interruptions affecting suppliers or technology providers.

17. Governing Law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where another law must apply.

Any legal proceeding relating to these terms or the website must be brought in a court with appropriate jurisdiction in Florida, unless applicable law provides otherwise.

18. Severability and Waiver

If a provision of these terms is found unenforceable, the remaining provisions will continue in effect.

A failure to enforce a provision is not a waiver of the right to enforce it later.

19. Changes to These Terms

We may update these Terms of Service periodically.

Changes will be posted on this page with a revised “Last updated” date. Continued use of the website after an update constitutes acceptance of the revised terms to the extent permitted by law.
